The arbitration will be administered by the International Chamber of Commerce ("ICC") in accordance with the ICC Rules of Arbitration then in effect, except as modified by this Disclaimer. The arbitration will be conducted in the English language by a single arbitrator with experience in matters relating to financial services and technology.
YOU AND ZYBERNO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. YOU AND ZYBERNO AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
